How To Lawfully Recover Property Scammed By Relatives

One of the most frequent issues among siblings and other family members is property conflicts. Regardless of their financial condition, family members often fight over real estate. Many individuals have a tendency to lie to their family members in order to guarantee that they get the overwhelming portion of the possessions when they are allocated. In a nation like India, there is a tradition of keeping property in common with the family, but as soon as the oldest member passes away, there are arguments about who would get the largest portion. Members of the same family have lied to one another in relation to property in a number of instances.<img decoding=”async” class=”alignnone wp-image-96531″ src=”” alt=”” width=”1327″ height=”772″ srcset=” 294w,×87.jpg 150w” sizes=”(max-width: 1327px) 100vw, 1327px” />

Revocation of the Land Registry

When land or property is fraudulently hijacked, it often indicates that the individual who was required to sign the contract letter for the sale of the property was coerced into doing so. Once the seized land has been registered, the first thing to do is to raise a complaint with the registrar and ask for the registration to be canceled. However, a request to annul the land register should be made right away if it is not completed. Then, a lawsuit about the cancellation of the contract letter should be brought in civil court to reclaim the land.

Pass Section 420 of the IPC.

A case is brought under Section 420 of the IPC for unlawfully or fraudulently seizing the land or property when it has been usurped in this manner. A person may submit a complaint at the police station under this provision if they are intimidated into leaving the property or have been duped. For information or to resolve a land dispute, a person may go to the District Court, Sub Registrar Office, Land Records Department, Nagar Panchayat, or Municipality.

An individual should be able to show their ownership of their property via their registration papers, account numbers, and transfer orders while bringing a lawsuit against family members who are dishonestly usurping the land.
